Trademark Classes
Trademark is a type of Intellectual Property that allows you to differentiate your products or services from those of your competitors. Any word, design, symbol, phrase, or combination of these things capable of distinguishing your goods or services can be registered as a trademark.
Trademark registration is important because it stops others from stealing your brand and using it to misrepresent other products. This makes it really important to protect your business as well as your consumers.
Trademark Class Details
There are 45 trademark classes and a trademark can be registered under any one or multiple classes. Each of the 45 classes represents a distinct set of goods or services. It is common for businesses to register trademarks under all the classes relevant to their products.
- 34 classes fall under the goods category.
- 11 classes belong to the services category.
Trademarks are segregated into 45 different classes by The International Classification of Goods and Services For a Trademark, also known as NICE classification. An entity can file an application for the same mark but under a different class. That’s why it is important to register your trademark under all the relevant classes.
Importance of trademark classes in India
Many people believe that registering their trademark gives them blanket ownership, however, this is not the case. For example, if a company has already registered its name as a trademark for use in connection with computer software, another company can still file a trademark application for the same name in connection with clothing.
As a result, it is important to understand how trademark protection works for different classes. While a trademark registration can provide some degree of exclusivity, if not applied to all the related classes it is not necessarily a guarantee of exclusive use.
It’s crucial to do a thorough search to make sure that a similar or identical trademark doesn’t already exist for the goods you’re looking to register. This search must be done for each trademark class under which you want to apply. Do your due diligence and ensure there are no existing trademarks that conflict with yours to avoid any potential problems down the road.
